Mediation Services Overview
In mediation
the focus is on exploring solutions and not securing victory by
vindicating a particular position or point of view.
Participants get to keep their convictions about the right of
wrong of a particular position, and shift to exploring mutually
beneficial settlement opportunities.
A skillful
mediator is an advocate for the process and does not take sides.
However, it is critical for a mediator to assist in
evaluating the alternatives to a mediated solution, which involves a
collaborative analysis of the relative strengths and merits of the
alternatives to settlement, including the legal positions of the
parties.
We know from
experience that mediation results can vary depending on the
personality and skills of the mediator.
Some are too passive. Some function as if they were a judge
or arbitrator of the dispute.
Some have a great deal invested in reaching a mediation
agreement. Mr. Bordelon is an assertive advocate of solutions and
willing to state his frank opinions on the merits of the positions
of the parties. Mediation success depends primarily on the
willingness of the parties to honestly appraise their positions
based on interests and not positions.

Coastal Zone Conservation Commission - Appeals Analyst.
1972 to 1975. Employment by the statewide Commission as a Planning
and Appeals Analyst. Responsible for the preparation of planning
documents and appeal recommendations for development projects along
the California coastline.

County and Nevada County, California, Resource Conservation
Districts - Program
Director. 1975 to 1978. Program Director
responsible for all aspects of the administration of its various
resource conservation programs.

Resource Conservation Commission - Executive Director.
Interim six month appointment as the Executive Officer of the
statewide California Resource Conservation Commission.
Leadership in the design and promotion of a new program for
the Commission and Resource Districts.
o Law Practice. 1977 to Present. Partner in law office from 1977 to 2002. Solo practice from November 2002 to the present. Based in Placer County, California. Emphasis on real estate, construction, and land use practice (including environmental) areas as private planning consultant and attorney. Transactional and civil litigation experience. Mediation and Arbitration.

and Associates, Inc.--Land
Development, Planning, and Brokerage Services
2005 to present. Principal owner of land development, resource
conservation planning, and real estate brokerage firm.
III.
Education and Licenses
Attended Beloit College, Beloit, Wisconsin, majoring in sociology, and received a LLB from Lincoln University Law School, Sacramento, California in 1977. He has taught real estate and land use law at a local state college, and conducted various seminars on matters of interest to land use professionals. Mr. Bordelon is a licensed California Attorney and Real Estate Broker. He has had advanced leadership and ADR training.
